Women, particularly daughters, have always been a deprived lot in terms of property rights in India. In ancient times, daughters were not given any portion of ancestral property, and at the time of marriage, were provided with some goods or money through the form of dowry. However, the legal provisions have modified and now daughters have become rights to inherit father property equal to that of sons.
Legal Changes
In 2005, the Hindu Succession Act, 1956 was amended. Under this amendment, daughters were given equal rights as sons in father’s property. That is, the daughter shall get rights in father’s property from birth, no matter if the father died before the amendment act came into effect or after. This right is not restricted to self-acquired properties but extends to ancestral properties too.
Steps Towards Women Empowerment
The very reason behind this legal change is to ensure women’s rights in the economy. That is because back in the days, rights on property did not exist for daughters hence making their lives very miserable financially and dependent on men. Now, with rights on property for daughters, independence economically is promoted thus better social standings.
Social Challenges
Nevertheless, it continues to be challenged by the society towards many legal rights. There have been instances when the daughter has unable to claim her right owing to family pressure or the influence of the society. Apart from them, some people still stick to ancient traditions and do not consider daughters worthy of even a single share in all properties.

This right deserved by a daughter as inheritance in a father’s property is one important change in law, which happens to be making a big leap towards being an economically independent woman. However, it needs awareness and education for complete realization of this right within society. Daughters must be made aware of their rights and legal assistance be sought whenever needed. Society also should embrace this transformation and practice equality with women.
